MINUTES

The Montgomery County Drainage Board met on Tuesday, February 6, 2007 in the City Council Chambers, Crawfordsville City Building, 300 East Pike Street, Crawfordsville, Indiana.

Those members present were as follows: Commissioner Phil Bane, Chairman; Commissioner William D. McCormick, Vice Chairman; Commissioner Harry A. Siamas, Member; Deanna Durrett, Member; Drainage Board Administrator Tom Cummins; and Drainage Board Secretary Lori Dossett.

Also present: Drainage Board Attorney Suanne Milligan; Wade Bennett; CK Wilkins; Barry Lewis, The Paper; Rob Durrett; Marian Lindow-League of Women Voters; Bob Stwalley; John Frey; Leon Weber; Mary Rose Duncan; William Crowe; Don Crowe; Tek Smith; Ernest Warren.

Drainage Board President Phil Bane called the meeting to order @ 8:00 a.m. and led the Pledge of Allegiance and Reverend Alan Goff led the prayer.

Deficit Drain Hearings

#524 George Hinkle Drain - 2,300 feet of open ditch, 2,100 feet of tile, 496.9 affected acres, $1.25 current rate, yearly assessment $621.13, deficit amount $8,042.41, proposed yearly assessment $8,042.41, proposed rate $16.19. Bill McCormick moved to raise the rate to $8.00 per acre on the George Hinkle Drain. Deanna Durrett seconded. 4-0 votes in favor.

McClaskey Drain - 1,522 feet of Open ditch, 7,930 feet of tile, 682.17 affected acres, $1.61 current rate, yearly assessment $1,122.35, deficit amount $11,488.94, proposed rate $10.24; proposed yearly assessment $11,488.94. Bill McCormick moved to raise the assessment to $8.42 per acre per year on the E.P. McClaskey Drain. Deanna Durrett seconded. 4-0 votes in favor.

Earnest Warren, landowner addressed the Board and questioned what he is getting for the increased assessment. Deanna Durrett explained that two payments were made to Wilson Construction in 1999 and 2005 and that is why there is a deficit in this drainage account. Harry Siamas moved to increase the assessment to $8.37 per acre on the George McClain Drain. Bill McCormick seconded. 4-0 votes in favor.

three years to pay it and advised the drain is in good condition. He advised that he and his son have in the past repaired the drain themselves because it needed to be done. Leon Weber explained when the work was performed and Deanna Durrett advised him that the $9,000 worth of work repairing the headwall should have been a reconstruction loan and not taken out of the drain funds considering the drain only brought in $850 per year. Bill McCormick stated the Commissioners at that time were aware that the drain did not have any funds in the account but at the recommendation of the Surveyor they were told it was an emergency repair. Bill McCormick moved to raise the assessment to $4.37 per acre on the John Martz Drain. Deanna Durrett seconded. 4-0 votes in favor.

Staff Report

Inventory of Drains - Deanna Durrett advised that the Inventory of Drains has been reformatted from the previously titled Montgomery County Legal Drains Classification for 2004. She advised the recent rate increases are not included on the inventory and the inventory will be updated in the next few weeks.

Certificate of Error - Landowners on the John Walkup Drain will be refunded the assessment they paid in 2006 since the drain should have been taken off assessment with the other 50 drains in 2006. Gayle Lough will be refunded assessment payment for three years on the Nancy Hollingsworth Drain because he has been billed for more acreage than his land drains.

Year-end Financial Report - Deanna Durrett explained the formatting of the Financial Report and advised that the Drainage Board records have been unable to reconcile with the Auditor's records. Councilman John Frey questioned why there was a resistance in the Auditor's office not to reconcile. The Drainage Board office will correct and maintain its own set of records in an attempt to reconcile all balances.

Contractor Qualifications & Rates - Drainage Board Administrator Tom Cummins advised that he has been contacted by two local contractors that have not responded to the qualifications and rates requested but expressed a desire to respond. The deadline had been set at January 29, 2007. The information requested is not for competitive rate purposes. James Hose Grant - Deanna Durrett advised that she has had an opportunity to interview a Grant Administrator and the next step is to meet with the Linden Town Board. Durrett will find out when the Linden Town Board meets and report back to the Drainage Board at the next meeting.

Drain Classification

Charles Ludlow#1 - Drainage Board Administrator Tom Cummins reported that the Charles Ludlow #1 was taken off assessment in 1968. He inspected the drain on January 17, 2007 and found that the drain washes along ditch banks from swelling of water; ditch needs debrushing and dipping in a few areas; the outlet is adequate. He advised that the drain is currently the outlet for the Theodore Templeton Drain as well as the tiled fields nearby. Deanna Durrett moved to request that Drainage Board Administrator Cummins submit a maintenance report at the February 27th Drainage Board meeting. Bill McCormick seconded. 4-0 votes in favor.

After inspection of the drain he classified the drain for reconstruction to resolve the issues on Barbara Hall's property as well as the outlet downstream. He advised the tile needs replaced between the retention pond and frontage road and needs to be reconnected to the tile as originally designed. Retention pond needs work to eliminate overflow and thus causing backpressure on the tile to the west. Landowner must resolve the issue of overflow and concerning the retention area to the south. Deanna Durrett moved to request that Drainage Board Administrator Cummins submit a reconstruction report at the February 27th Drainage Board meeting. Bill McCormick seconded. 4-0 votes in favor.

Certified Mail Analysis - Deanna Durrett submitted an analysis of certified mail for assessment rate increases. The Board agreed that the 10 day notice required by the Indiana Code for rate increases will be a 20 day notice instead.

Bill McCormick suggested that David Stanley from Soil & Water be invited to the meeting. Durrett advised that Angie Williams from Soil & Water is also planning to attend. She advised that the Drainage Board is collaborating with Soil & Water to prepare a brochure regarding filter strips comparable to Drainage Facts of Montgomery County. Harry Siamas requested that Drainage Board Attorney Suanne Milligan research if the Drainage Board has the authority or the power to require that landowners install filter strips on their farms. Deanna Durrett advised that Section 26 gives the Drainage Board that authority. 4-0 votes in favor.

The Board will provide a brief description of duties and the amount of time needed to serve on the Board. Candidates will be interviewed when a list has been compiled. Harry Siamas stated he will be leaving the Board in April. He advised because of the importance of drainage work it is difficult for Commissioners to serve on the Board as well as serving as Commissioner. The statute allows for the Commissioners to appoint four citizens and one commissioner to the Drainage Board. He will step off of the Board this year and one of the other Commissioners will step off next year. The Board has requested a recommendation from Soil & Water to fill the current vacancy on the 5-member Board.

He will step off of the Board this year and one of the other Commissioners will step off next year. The Board has requested a recommendation from Soil & Water to fill the current vacancy on the 5-member Board.
