MONDAY, OCTOBER 8, 2007

MINUTES

The Montgomery County Drainage Board met on Monday, October 8, 2007 in the conference room of the Crawfordsville Public Library, Crawfordsville, Indiana.

Those members present were as follows: Commissioner Phil Bane, Chairman; Commissioner William D. McCormick, Vice Chairman; Deanna Durrett, Member/Executive Secretary; Dave Rhoads, Member; Jack Grimble, Member; Surveyor Tom Cummins; and Drainage Board Secretary Lori Dossett.

Also present: Drainage Board Attorney Suanne Milligan; Aleasha Shelley, Journal-Review; Phil Campbell; and Marian Lindow-League of Women Voters; Dave and Brenda Foster; Bart Maxwell; Richard and Judy Harshbarger; and Kenny Pearson.

Chairman Phil Bane called the meeting to order @ 6:30 p.m. and led the Pledge of Allegiance and Reverend Alan Goff led the prayer.

Approval of Minutes - September 10, 2007 & September 24, 2007

Chairman Bane requested a motion to approve the September 10, 2007 minutes and the September 24, 2007 minutes as presented. Bill McCormick moved to approve the September 10, 2007 minutes and the September 24, 2007 minutes as presented. Jack Grimble seconded. 5-0 votes in favor. Motion carried.

Open Bids & Award Contract for James Sanders Drain

1) Darrell Birge - $28,800

2) Maxwell Farm Drainage - $32,550

Surveyor Cummins and Executive Secretary Deanna Durrett reviewed the bids and advised the Board that the bids were in order. Bill McCormick moved to approve the bid as submitted by Darrell Birge in the amount of $28,800 for the repairs on the James Sanders Drain. Deanna Durrett seconded. 5-0 votes in favor. Motion carried.

Bill McCormick moved to request that Darrell Birge lower his bid less the amount of the tile that will be left intact on the Phil Campbell property. Deanna Durrett seconded. 5-0 votes in favor. Motion carried.

Deanna Durrett advised that Kenny Pearson has filed with the Drainage Board office a Petition Asking for Advancement of the Date of the Reconstruction. Durrett advised that the next step is to schedule a hearing at the next scheduled Drainage Board meeting on Monday, October 22, 2007 @ 6:30 p.m. with the three landowners that signed the petition. Kenny Pearson questioned the decision to use corrugated tile on the project instead of smooth tile. Surveyor Cummins advised that it was requested to do the project as inexpensive as possible. Surveyor Cummins will provide the cost of the smooth tile at the October 22nd hearing.

Approve Vacation of Tributary on James Sanders Drain

Surveyor Cummins advised that the James Sanders Drain reconstruction project plans are crossing over I74 and bring in the new tile and destroy the old 15" like that runs to the outlet. Mr. Phil Campbell has asked that the line be left intact and vacate it and leave it as a private drain and run the new tile just to the north and run it to the north side of that old tile and leave it intact. Bill McCormick moved to allow the vacation of this certain section of the James Sanders Drain. Dave Rhoads seconded. 5-0 votes in favor. Motion carried.

Surveyor Cummins requested that the Raymond Weliever Drain be placed under Old Business at the next Drainage Board meeting on October 22nd.

Spray Program

Surveyor Cummins advised that he met with Tim Light from Light Lawn Service and Mr. Light is working up some figures for a spray program.

Financial Report

Deanna Durrett advised that the interest accrued is $1,633.05.

Deanna Durrett advised that Schneider Corporation will be giving a presentation of the watersheds on October 22, 2007 @ 3:00 p.m. at the Crawfordsville Public Library.

Surveyor Cummins requested approval of tile hole repairs by John Wilcox on the Albert Nobes Drain, 25 ft. 10" tile and 25 ft. 12" tile - $1,947. The repairs were made two years ago and the work was not done properly. He advised one hole is 10 ft. wide. Surveyor Cummins advised that the major landowners are requesting that the repairs be made and raise the assessment. Jack Grimble moved to accept the John Wilcox bid on the Albert Nobes Drain in the amount of $1,947. Dave Rhoads seconded. 5-0 votes in favor. Motion carried.

Deanna Durrett moved to schedule a hearing on Tuesday, November 13th at 6:30 p.m. to raise the assessment on the Albert Nobes Drain. David Rhoads seconded. 5-0 votes in favor. Motion carried.

Bill McCormick moved to adjourn. Deanna Durrett seconded. There being no further business before the Drainage Board, the meeting was adjourned. 5-0 votes in favor. Motion carried.

Bill McCormick moved to adjourn. Deanna Durrett seconded. There being no further business before the Drainage Board, the meeting was adjourned. 5-0 votes in favor. Motion carried.
