MONDAY, OCTOBER 22, 2007

MINUTES

The Montgomery County Drainage Board met on Monday, October 22, 2007 in the conference room of the Crawfordsville Public Library, Crawfordsville, Indiana.

Those members present were as follows: Commissioner Phil Bane, Chairman; Commissioner William D. McCormick, Vice Chairman; Deanna Durrett, Member/Executive Secretary; Dave Rhoads, Member; Jack Grimble, Member; Surveyor Tom Cummins; and Drainage Board Secretary Lori Dossett.

Also present: Drainage Board Attorney Suanne Milligan; Building Administrator Marc Bonwell; Aleasha Shelley, Journal-Review; Rob Durrett; Foster Farm Drainage; Steve Heimbach; Bill Dice; Marilee & Kenny Pearson; Dave Knowling; Marian Lindow-League of Women Voters; William M. Williams; Sam Valliere; Clint Wilkins; Wayne Kessler; Randy Borden.

Chairman Phil Bane called the meeting to order @ 6:30 p.m. and led the Pledge of Allegiance and Reverend Sparks led the prayer.

Approval of Minutes - October 8, 2007

Chairman Bane requested a motion to approve the October 8, 2007 minutes as presented. Jack Grimble moved to approve the October 8, 2007 minutes as presented. Dave Rhoads seconded. 5-0 votes in favor. Motion carried.

Old Business:

Odis Stafford Drain Reconstruction Hearing - Surveyor Cummins advised that notices were mailed and no one was present at tonight's meeting. Surveyor Cummins stated that he has been advised by landowner Barb Hall that the agreement that they had recently reached regarding redirecting the tile around the barrow pit straight into the open drain is not what she wants to do after all. She is concerned that it will lower her property value. Surveyor Cummins stated that the solution is above his expertise and requested that the Drainage Board approve that he contact Jeff Heely to get his advice on how best to proceed on the Odis Stafford Drain. Dave Rhoads moved to contact Jeff Heely to get his advise on the Odis Stafford Drain. Bill McCormick seconded. 5-0 votes in favor. Motion carried.

John Ward Drain Reconstruction Hearing Surveyor Cummins advised that the notices were mailed out. The Board will decide if the proposed work to be done on the drain should be treated as a reconstruction project or maintenance project and if monies in the Drainage Improvement Fund are to be used. Cummins estimated the project to cost $12,000 to $15,000. The drain currently has $2,495.66 in yearly assessments at $3 per acre. Bill Dice and Steve Heimbach were present for the hearing. The surveyor's office has not received quotes for the project, just an estimate from a contractor. That is the ballpark figure. All landowners did receive notice. Most problems are on Mr. Heimbach and down through Linsburg. There will be an additional assessment: Balance in fund now: $100 in the hole with the most recent expense of

Basil VanCleave Drain - Landowner Petition

The Surveyor's office has received a Petition to Advance the Date for Reconstruction. A hearing needs to be held at the next meeting on this petition. The purpose of the hearing is to hear from the petitioners regarding the need for reconstruction. Bill McCormick moved, seconded by Deanna Durrett, to set the hearing on the petition for November 26, 2007, at 6:30 p.m. 5-0 votes in favor. Motion carried. If on that date the Drainage Board agrees that the date for reconstruction should be advanced, the next step in the process will be to schedule a reconstruction hearing with notice and publication to all landowners on the drain. Drainage board Attorney, Suanne C. Milligan advised that at the landowner hearing the Surveyor must be prepared to say how much the project will cost. She recommends that the Board wait until the time for any appeal has passed before any monies are spent.

Basil VanCleave Drain - Surveyor Cummins presented an estimate for work on the drain from Vine Street to south of the railroad bed where the breather is currently located by. Conner Excavating estimate: $6,735.38 for 550' of 12" smooth core tile with fittings, installation & seed. The surface swale will be restored. Following discussion, Bill McCormick moved, seconded by Deanna Durrett, to accept the Conner Excavating estimate in the amount of $6,735.38 for the repair of 550' of this drain with 12" smooth core tile including fittings, installation and seed, from Vine Street in New Market to south of the railroad bed where the breather is currently located. 5-0 votes in favor. Motion carried. 5-0 votes in favor.

New Business:

Nucor Administration Building - Building Administrator Marc Bonwell presented revisions to the Nucor administration building project. He advised no movement of dirt is involved in the revisions and the plans have been reviewed by DLZ. The building will be located south of cold mill in front of old administration building. The building will be 16,000 square feet, with 20,000 square feet parking and no revisions are needed to the ponds. Bill McCormick moved to approve the revisions of Nucor administration building. Jack Grimble seconded. 5-0 votes in favor. Motion carried.

Drainage Board Appointment - Phil Bane requested that the appointment remain under old business. The new appointee to the Board should reside in southwest Montgomery County.

John Galey Drain Landowner Meeting - Phil Bane called the John Galey Drain Landowner meeting to order @7:30 p.m. The Galey Drain was approved by the Board for reconstruction in 2005 with an estimate cost of $70,000. Surveyor Cummins advised that there is a question as to what is needed to repair the drain. New waterways have been installed in the past two years and tile holes have been repaired. He advised that the project is over a major gas line and crosses the railroad tracks. He has received an estimate for an engineer's study in the amount of $15,700 and requested permission to send out an RFP to other engineering firms to do an engineering study of the drain and to set the matter landowner meeting on December 10, 2007. Deanna Durrett moved to instruct Surveyor Cummins to request at least three bids for

the cost of an engineering study on the John Galey Drain. Dave Rhoads seconded. 5-0 votes in favor. Motion carried.

Inspection/Classification Reports - Surveyor Cummins presented Classification Reports on the Sarah Kincaid Drain; Benjamin Crabbs; Timothy Lane; Urshall Cross, Boswell Clough, Richard Thomas, Benjamin Remley and Harrison Doyle reports. Jack Grimble moved to accept the Inspection/Classification Reports. Dave Rhoads seconded. 5-0 votes in favor. Motion carried.

Bill McCormick moved to adjourn. Jack Grimble seconded. There being no further business before the Drainage Board, the meeting was adjourned. 5-0 votes in favor. Motion carried.
